Terms of service

Managed Garden is operated by Square Post Labs Inc. By creating an account you agree to these terms. If you are agreeing on behalf of a business, you confirm you are allowed to do that.

We build, host and maintain your website. That includes publishing your content, keeping the site online, taking backups, and being able to roll back to a previous published version.

• You own your content, your brand and your domain name. Nothing here transfers ownership to us.
• You give us permission to store, process and publish your content, because that is how we run your site.
• You are responsible for having the right to use what you publish, including images and text.

If we register a domain on your behalf, it is yours. You can transfer it to your own registrar account at any time and we will help rather than obstruct. We will not hold a domain hostage against an unpaid invoice.

Do not use Managed Garden to:

• break the law, or help someone else break it;
• publish content you do not have the right to publish;
• attack, overload or probe our systems or anyone else’s;
• send unsolicited bulk email, or host material that exists to deceive people.

If something you publish puts the platform or other customers at risk, we may take it offline and then talk to you about it. We will tell you what we did and why.

Your published site is served as static files from a global network, which is a deliberately simple and resilient way to run a website. We work to keep everything available, but we do not currently offer a contractual uptime guarantee, and we would rather say so than publish a number we do not yet measure. If that changes, it will change here first.

Planned maintenance that could affect you will be announced in advance where we reasonably can.

Plans and prices are shown on the pricing page. Fees are billed in advance for the period you choose. If a payment fails we will contact you before anything is suspended.

You can cancel at any time and your service runs to the end of the period you have paid for. We do not lock you in with notice periods. On request we will give you an export of your site so you can take it elsewhere.

We may suspend or end an account for non-payment, or for a serious breach of the acceptable use section above. Except where the law or an emergency requires otherwise, we will give you notice and a chance to put it right.

We will do our job carefully, but we cannot be responsible for indirect or consequential losses, such as lost profits or lost business, arising from use of the service. Our total liability in any twelve-month period is limited to the amount you paid us in that period.

Nothing in these terms limits liability that cannot lawfully be limited.

If we make a material change we will email you rather than silently updating this page. Continuing to use the service after that means you accept the change.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
